First: FCC Part 15, linked to above, is the main catch-all for license-free devices under 47CFR (the FCC regs). It’s a wonderful mish-mash of stuff, new and ancient. Some things are allowed on almost any frequency as long as the power level is lower enough. Car remote keyless entry would be illegal at the frequency it runs on (315 MHz) except for the fact that the power is low enough.

Anyway, yes… scroll down to 15.23 and you’ll see the provision for homemade equipment.

Second: based on activity at the park a block from my house, the answer is “yes”.
